Commercial Contract Specialist - Based near Edenvale

MAIN PURPOSE
? The purpose of this position is to analyse commercial contract terms and identify areas of risks and mitigating of the risks related to the application of contract clauses.
? To quantify the risk value and be able to provide mitigating contractual language or article project related solutions to minimise risk.

DUTIES AND RESPONSIBILITIES
? Manage and coordinate contract administration activities, providing contract administration resources to bids and projects, ensuring that all aspects of the contact during the bidding and execution phase are addressed with the objective of contributing to maximize project revenues.
? Assist with the bid handover and booking process and ensure that the necessary commercial information is understood and disseminated to the extended project team.
? Ensure compliance with the project specific contractual administration requirement.
? Review and negotiation of commercial contracts with suppliers and clients in RSA and across Africa (international).
? Manage escalations/disputes between suppliers and the business users and ensure resolutions to disputes by being point of expert and reference for contracts.
? Successfully negotiate contracts with customers.
? Reviewing and updating of templates, drafting of new contracts needed by the business.
? Facilitate and support client negotiations from a legal contracting perspective.
? Review /evaluate the contracting process across the group from negotiation to conclusion and identify areas and methods of improving the process.
? Review any contracting requirements per country.
? Reduce the contracting risk of the business.
? Manage poor performance of suppliers at operational level using remedial actions/plans and or contractual mechanism
? Facilitate continuous engagement with suppliers and become a single point of contact for suppliers to engage operations on all contractual and operational execution issues.
? Manage contract compliance and payment terms as per the company policy.
? Closely monitor contract compliance and flags areas of non-compliance for corrective action.
? Contribute to the development and implementation of the business and contractual management strategy by providing accurate and timely information on current and future views of the business.
? Set-up general terms and conditions for the commercial and manufacturing sectors of the business.


QUALIFICATIONS AND EXPERIENCE
? Bachelors Degree in Business Administration or LLB Degree / Commercial Law / Contractual Law required.
? Minimum of 10 years contract management experience of which 2 years on management level.
? 2 years experience in commercial contract negotiations and compilation field.
? Extensive experience working in the management of contracts / construction management for multiple projects greater or high net worth projects , dealing with NEC, FIDIC and 99 forms of contracts.
? Having worked in a construction environment will be an advantage.
? Full understanding and working knowledge of the key legal risk areas such as but not limited to Contractual Liability, insurance requirements, defective performance etc.
? Knowlege and experience in medium to complex negotiations and contacts management.
? Sound contractual and commercial knoweldge and change management (e.g. techical skills, contact law)
? Basic understanding of international (cross-border) compliance and logistic requirements and / or legislation.
? Sound knowledge of construction industry legislation impacting on the effective business practice and excellent corporate gorvenance in RSA.
? Proficient in MS Office Suite: Word, Excel and outlook.
? Good typing skills.
? Knowledge of Syspro will be advantageous.
? Knowledge of CRM systems is preferred.

WORKING CONDITIONS
? Will be required to travel to manufacturing sites to ensure adherence.
? Required to work beyond normal working hours, evenings, weekends and holidays should the need arise.
