a Mining Company in Rustenburg is looking for a Corporate Lawyer.

Requirements:

LLB Degree with completed Articles
Admitted Attorney / Advocate
At least 4-6 Years post qualification experience in Commercial Law

Knowledge and Exposure:

Precious Metals Act and Informal Land Rights Act
In depth knowledge of the Mineral and Petroleum Resources Development Act
Knowledge of Mining Charter, BBBEE Act and codes of good practice
Knowledge of all relevant environmental legislation
Knowledge of Labour Legislation, Mine Occupational Health and Safety
Knowledge of general commercial laws including, but not limited to, Companies Act, POPI, Insolvency Law

Duties / Responsibilities:

1 Engage with business and assess that relevant procurement strategies are in place
2 Engage and negotiate with suppliers including the management and resolution of disputes, when required
3 Oversee and continually update standard form contracts as well as tender documents in line with relevant legislation
4 Review OPEX and CAPEX contracts, tenders, modifications, drafting of letters such as notices of breach and terminations
5 Formulate responses to the BEE Commission and form part of the Fronting Team which investigates potential fronting activities of suppliers
6 Assist with development and comments to policy documents, procedures, frameworks, Codes of Conduct, Approval Framework
7 Assist Procurement with becoming compliant in terms of POPI and address various queries from suppliers relating to POPI, Ethics, conflict of interests and the like
8 Monitor legislation regularly and changes thereto (Companies Act, MPRDA, Mine Health and Safety Act, Environmental Law, BBBEE Act, Codes of Good Practice and Mining Charter and related legislation applicable to the mining sector
9 Present to various committees when required such as EXCO, OPCO, RPCM
