An opportunity for the Enforcement Specialist position exist at one of our clients in the Financial Regulatory sector based in Centurion to join their compliance and prevention department, to lead and provide expert guidance and advice on administration and processing of enforcement matters in terms of the Financial Act, No 38 of 2001.

Job Description:
• Lead and plan the execution of complex enforcement matters from end to end.
• Provide guidance and ensure knowledge transfer to team members, related to all areas within the relevant field of expertise.
• Provide direction in terms of the execution of enforcement in compliance with the external governance principles.
• Identify non-compliance and make recommendations on enforcement action to be taken.
• Present enforcement matters to the Adjudication Panel and Director.
• Review and quality assure enforcement documentation.
• Appeals: conduct legal research (review case law) and provide draft papers for the appeal process. Appear on behalf of the organisation in appeal matters, e.g. finalisation of appeal documents and arguing the matter.
• Provide expert guidance and advice on supervision and enforcement matters.
• Direct internal and external stakeholder engagements.
• Build and maintain a network of influence with internal and external stakeholders that will enable leveraging opportunities.
• Engage with Supervisory Bodies on recommendations regarding oversight and enforcement issues that span across Supervisory Bodies.
• Provide expert regulatory advice on structural regulatory and technical issues including advising on constitutional challenges in complex matters.
• Recovery of fines: monitor payment of sanctions, refer non-payment to corporate legal services for recovery.
• Monitor and report on regulatory enforcement actions of supervisory bodies.
• Recommend improvements on the administrative sanction processes to the organisation.

Required Qualifications and Experience:
• LLB degree or relevant tertiary qualification.
• Relevant postgraduate qualification.
• Strong legal compliance and risk management knowledge.
• Sound knowledge and experience in business processes
• Strong litigation skills.
• At least 10 -15 years’ experience in relevant field i.e. prosecution or regulatory experience.
• The prospective candidate should have an advanced understanding of administrative law and enforcement.
• Possess exceptional writing skills and be a good verbal communicator with proven interviewing, interpersonal and problem solving skills.
• A high level of judgement and integrity is crucial for this position.
• An intermediate to advanced level of computer literacy, including MS Word, MS Access, MS Project; MS Excel, MS Power Point.
