Duties:
• This position is responsible for the translation of the company’s organisational strategies and initiatives into Supply Chain Management including Contracts systems and processes and the functional management thereof. To oversee and provides direction with regards to the full Supply Chain Management and Contracts Function so as to ensure legislative and good practice compliance.
• Provide direction with regards to the development of supply chain strategies that supports all operational units to respond to set organisational objectives. The execution of all the Supply Chain Management policies broadly planned or programmed within the limits of discretion set by top management. The Senior Supply Chain and Contracts Manager has to come to a decision on supply chain and contracts composition, overall process improvements for major units and functions, the relationship between major functions/units and the major operational objectives in line with Supply Chain Management and Contracts to improve efficiencies.
• Overall would be to lead the Supply Chain Department within the company to support the organisational strategic objectives of the company as well as to comply with the Public Finance Management Act (PFMA).This includes all Treasury regulation; Tax regulation; Preferential Procurement Policy Framework act; overseeing all activities relating to Supply Chain Committee and its related committees. To ensure that all company contracts are properly managed, legally sound, do not expose the company to any unnecessary legal issues and gets value for money on all its contracts.

Formulation of the Supply Chain and Contracts Management Strategy
• Formulation of the company’s Supply Chain and Contracts Strategy, Operational plans and implementation thereof.

Provide advisory services to all company Divisions and its Units
• Management advised on compliance related issues and guidance provided as per client requests in accordance with developed guidelines.

Management information and reporting
• Statutory reports compiled and submitted in accordance with legislative requirements, on time, complete and accurate.

Risk management and Audit requirements
• Control measures developed, implemented and monitored and corrective action taken to ensure audit compliance and adherence to good governance principles and the PFMA.

Supply Chain Functions Management
• Updating and formulation of the Supply Chain and Contracts Policies, Standard Operating Procedures and guidelines
• Oversee the effective running of the Supply Chain unit to ensure compliance and enhanced service delivery
• Provide support through the tendering process and report to the SCM procurement Committee in line with the set compliance procedures.
• Provide technical advice and guidance to all SCM Committees.

Contracts Management Functions Management
• Oversee the effective running of the Contracts Management unit, ensuring that all legal contracts are vetted, aligned to the TOR, and in compliance to laws and regulations.
• Provide support to the contract management process and give guidance where required.
• Contracts are drafted in compliance to best legal practice and principles and in line with all other applicable legislation.
• Guidance on contract matters, legal advice and training
• Provide advice on contractual matters to the Bid Specification Committee
• Drafting of legal opinions or advice
• Briefing Attorneys on complex matters
• Review of legal documents, understanding of the context, and discussion with relevant parties on the way forward
• Negotiating terms and conditions and ensuring compliance
• Dispute resolution
• Guidance on amendments.

Oversee development of Department budget
• Budget developed meets requirements in respect of operational plan roll out and set in accordance with PFMA and other guiding legislation
• Cost benefit analysis carried out and expenditure optimally structured.

• Management of all company’s Stakeholder relationship in ensuring quick turn-around
• Times, reliability of information provided, and on time delivery of services

Qualities, experience, knowledge and skills required

• Post graduate qualification in Supply Chain Management/ Accounting/ Commercial Law
• 5 years’ experience in total management function, and developing and maintaining controls
• Supply Chain experience and Contracts Management experience.
• Knowledge of relevant legislation, PFMA, Treasury Regulations; Preferential Procurement
• Policy Framework Act and GRAP.
• Knowledge of Commercial Law or Laws of Contracts.
